EMMA EUSTACE
Level 4 personal trainer, class instructor, nutritional advisor, life coach & owner of BML Personal Training and Fitness Studio.

Emma started life as a Step Aerobics Instructor back in the 90's and then left the fitness industry to pursue a career in fashion. Having achieved her career goals and becoming disillusioned by the fashion industry, she decided she wanted to get back to helping people by using her experience as a fitness expert, whilst also using her own personal battle with weight & fitness over the years. Emma is a dedicated fitness expert whose passion is helping others lead a health lifestyle that fits in with their life.
As a mum to an active 11 year old boy and wife to an equally active husband, she understands the need for all to lead a healthy life style and help infuse this in the new generations.

Privacy Policy through the BML website;

We receive, collect and store any information you enter on our website or provide us in any other way. In addition, we collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information and purchase history. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. We also collect personally identifiable information (including name, email, password, communications); payment details (including credit card information), comments, feedback, product reviews, recommendations, and personal profile. Annually we also collect your health data to ensure you are fit to exercise and to make sure we can plan sessions accordingly taking into consideration how you have answered the PAR-Q.
How do we collect information?
When you conduct a transaction on our website, as part of the process, we collect personal information you give us such as your name, address and email address. Your personal information will be used for the specific reasons stated above only.
Why do we collect such information?
We collect such Non-personal and Personal Information for the following purposes:

How do we store, use, share and disclose your site visitors' personal information?
Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.
All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

How do we communicate with your site visitors?
We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, services offered and the latest news, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. For these purposes we may contact you via email, telephone, text messages, and postal mail.

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

What we do with that information;
The information is used to create your personal development plan, record any injuries, set you up on the BML mailing list and if you have registered for classes, your email is used on the Wix BML booking system to book you onto classes. Contact details are saved so that BML can keep you empowered by sending information on health and nutrition, as well as keeping you informed of any important changes about the BML Services. The booking system also keeps you updated with any changes to classes which may sometimes happen.
We will never sell your data and we promise to keep your details safe and secure.
Information retention;
You have full control over your information with BML. All information kept can be deleted via the BML web site. You may also Email Emma@bmlpersonaltraining.com to remove any email correspondances etc. Information is kept for upto 1 year after you have finished exercising with us. You may delete this, or ask us to delete this at anytime.
Data Collection
Once a year BML will ask you to sign a health Waiver form and PARQ – this is so any changes to health can be monitored, it also allows BML to ensure everyone has full visibility of its terms and conditions. Wix is the data processor and Emma Eustace is the data controller.
Terms and Conditions;
Health Screening

All clients must complete a health questionnaire (PAR-Q) before commencing any exercise programme.

BML may require a letter of ‘medical clearance’ from your GP.

It is the responsibility of the client to maintain the accuracy of their enrolment form and notify BML immediately if there are any changes to their health / contact details / emergency contact details.

BML will do its upmost to ensure a safe environment in the studio however you undertake these classes entirely at your own risk.

BML Online Classes will ask you to check the environment around you to ensure it is safe and free of trip hazards, it is your responsibility to ensure your workout area is safe. BML accepts no responsibility for injury at home.

By signing this agreement, you confirm that to the best of your knowledge that you suffer from no physical disability, health concern or illness which would prevent you from undertaking the classes safely, whether or not such disability or illness may be affected by exercise of whatever degree; and further agree to advise the instructors if, after becoming a member, you suffer from such a disability, injury or illness. By signing our enrolement form, you agree to indemnify the instructors’ class in respect of any disability or illness whether suffered in class or otherwise.
Cancellation Policy
Exercise classes;

In the event that a class has to be cancelled, BML will endeavour to give 24 hours’ notice and a credit will be offered to all participating clients to be used within the next block of classes.

Monies paid are non-refundable unless you have cancelled 24 hours prior to the commencement of the class. Refunds shall not be given for non-attendance. Fee Charging Policy.

Payment for block bookings for classes must be made at the time of booking.

BML does offer a ‘Pay as you go’ scheme for those wishing to partake in adhoc classes – these are still bookable online.
PT’s;
-
CANCELLATIONS must be made 48 hours in advance of schedule training appointments to get full payment back, 24 hours for half amount of PT session back. Please notify Emma Via Text or email.

NO SHOW: clients that fail to show for their scheduled appointments will forfeit the full amount of the sessions. More than 2 no shows may result in the contract being terminated.

LATE SHOWS A 10 minute rule will apply for scheduled appointments. If you don’t show within 10 minutes past your scheduled appointment, the personal trainer will not be obligated to train you on that particular day. If the trainer decides to leave, you will forfeit a paid training session. If the trainer stays and you show up, they will only train you for the remainder of the scheduled training hour.
Disclaimers, Terms and Conditions

By signing BML's health waiver and PAR-Q forms, for the duration of the time that you are an active client with BML and up to 1 year afterwards for this data to my data being held on a centralised secure database as mentioned in the privacy policy and that your online registration details will be kept until you decide to delete them. These will be used for the purposes of marketing and administration by BML. I understand that my details will not be shared with any third parties.

BY paying for classes online you are agreeing that you are of sound health to exercise in the studio, via virtual classes at home or via ‘On Demand’.

If you consent to being booked on to the online booking system, you consent to your Name and email address being shared with Wix.com; the online booking system & web site host.

I understand that the instructors accept no responsibility for any loss, damage, or injury to any participants / non participants, or to the personal property of any participant / non participant (or to any person accompanying whether by invitation or otherwise) who enters upon the instructor’s premises for whatever purpose and whether such loss, damage, or injury is caused directly or indirectly by the instructors.

If you register online or via the wix app for classes you will be sent email confirmations of bookings and cancellations. This information sits with Wix but can only be accessed by yourself and Emma at BML.

You recognise and understand all the terms and conditions set out above between BML and yourself and agree to follow all the guidelines as listed.
Adverse Weather conditions
In the event of snow and Ice all classes and PT sessions will carry on as normal unless Emma or the instructor for the class/PT deems it unsafe to do so.
If the instructor deems it unsafe then the class will be cancelled and money will be credited, or carried over into the next block. If it is deemed safe to attend the class/PT session and the class/pt session continues, but you are unable to make it the fee charging policy above will still apply.

Virtual Classes - BML Exercise at Home – Terms and Conditions
By exercising at home and following BML exercise classes on Zoom the user must agree to be bound by these terms and conditions.
Agreement

These terms and conditions are the terms on which the Service may be made available to you from time to time. By booking online or via the wix app for BML online you are agreeing to exercise at home via Zoom you agree to be bound by these Terms. If you do not agree to any of these Terms, then please do not book on and exercise via Zoom.
By agreeing to there terms you agree to;

Check your space and ensure the area around you is clear of obstacles and is safe.

If any children are joining in at home this is the guardian’s sole responsibility to ensure they are safe, BML cannot take any responsibility for any injuries caused while exercising in your own home.

By booking onto BML’s classes, you are agreeing that you are of sound health to do so.
Online Health Agreement Disclaimer;
You should consult your physician or other health care professional before starting this or any other fitness program to determine if it is right for your needs. This is particularly true if you have a history of high blood pressure or heart disease, or if you have ever experienced chest pain when exercising or have experienced chest pain in the past month when not engaged in physical activity, smoke, have high cholesterol, are obese, or have a bone or joint problem that could be made worse by a change in physical activity. Do not start this fitness program if your physician or health care provider advises against it. If you experience faintness, dizziness, pain or shortness of breath at any time while exercising you should stop immediately. Please also do not exercise if you Are experiencing any of the symptoms of Corvus-19.
By paying to attend the class you are agreeing that you are of sound health to exercise along at home.
